Update for INMO Members
Re: Regularisation of Actors
Dear Colleagues,
Further to previous updates in the World of Irish Nursing and, as set out below, we have been advised by the HSE that the business case has only recently been submitted by them to the Department of Public Expenditure and Reform.
This business case sets out the arguments in favour of regularising Actors, based on the principles already set out in the Labour Relations Commission document which was negotiated between the INMO, SIPTU, MSLA, IMPACT, TEEU and the HSE on the 20th of July 2012. We have voiced our disquiet and concern regarding the delay in progressing this matter to the HSE and have requested a copy of their business plan which was submitted to the Department.
As you may be aware the unions have advised that they will only consider regularisation of Acting in the context of the Labour Relations Commission document, which sets out principles. We have not been advised, to date, of the response from the Department of Public Expenditure and Reform and as soon as we are advised of its response via the HSE, we will notify members and consider this response with our Executive Council.
Any update will be made known on this website as soon as it has been advised to the unions.

Notice To Members.
RE: Regularisation of Acting Posts (24th September, 2012)
Further to previous updates relating to the regularisation of acting posts, you are aware the INMO and other Health Sector Unions (SIPTU, MLSA, IMPACT and TEEU) are trying to get regularising of acting secured. This requires the HSE to make a business case to the Department of Public Expenditure and Reform. They are, as at our most recent meeting with them on Thursday 20th September, in the process of writing up this business case, based on collated information. We are to meet again in early October to review progress. If this business case is acceptable to the department of Public Expenditure and Reform, then negotiations will commence in respect of actual process of regularisation, which will be based on the principles already set out in the Labour Relations Commission document negotiated between INMO, SIPTU, MSLA, IMPACT and TEEU and the HSE on 20th July 2012.
The detail of actual posts to be converted from Acting to established posts will only emerge after the Department’s agreement to the principle has been received. While we appreciate this issue is of utmost importance to INMO members we cannot progress the issue any quicker, as the HSE have advised that they cannot progress until the Department of Public Expenditure and Reform, has given the HSE authority to continue with these negotiations.
The INMO commits to continuing with the representations on these issues as a priority issue.

Regularisation of Acting Posts (Update 6th September 2012)
Further to the Notice dated 25th July last, I can now confirm that a follow-up meeting to discuss the proposals put forward at the Labour Relations Commission on 20th July 2012 has been confirmed for Thursday 20th September 2012.
I will update members immediately post this meeting.

Current Update on:-
1. Regularisation of Long Term Acting; and
2. Senior Staff Nurse
Phil Ni Sheaghdha, reconvened with the group of Unions at the Labour Relations Commission (LRC) on 20th July last and at that time no firm conclusions were reached in respect of the above.
The Unions presented well and Management seemed to take on board a number of points which were made.
The group will meet again in early September for on-going discussion and the HSE have given a commitment that they will have a document prepared for presentation to the Unions which will be negotiated at that time. On receipt of any documentation etc. we will contact you further but, please be advised it will be at least early September before any further update is given.
If anything is forwarded during my absence on annual leave, Liam Doran will be looking after these issues and we will keep you updated.

RE: Regularisation of Acting Posts
Dear Colleagues,
Further to my previous note dated 25th May 2012, I confirm that a conciliation conference did resume on 13th June 2012 at 4.00pm and continued until 8.00pm. A discussion document was presented to the Unions and Management, as previously agreed by the Conciliation Officer of the Labour Relations Commission and, this formed the basis of the discussion on the 13th June. Disagreement still remains between the parties in relation to the criteria which would be used to regularise staff who are currently acting.
• As you are aware, the Unions including the INMO are seeking to regularise, after two years in an acting capacity;
• Management are seeking a longer period of three years;
• The Unions are seeking to include as many grades as possible.
Management are seeking to restrict the regularisation process and Conciliation was adjourned on the 13th June with a request from the Conciliation Officer to management to get details of employees who are acting and length of their acting, this request is to try and establish the material difference between two and three years.
While some progress was made at the Conciliation Conference, the matter is not resolved. The parties are to reconvene on 17th July and at that point all of the information should be available to us. The Unions involved, including the INMO, will endeavour to get a proposal from that meeting under the auspice of the LRC that can then be considered by the Executive Council. If agreement cannot be reached however, the normal process would be that the matter would then be referred to the Labour Court. The INMO will keep you advised as to the outcome of the Conciliation Conference on the 17th July and are hopeful that a proposal will emerge.

Dear Colleagues,
As you are aware the INMO and other health service unions have been engaged in national talks over the past year seeking to agree the regularisation of acting posts for those acting in the employment of the HSE. A number of meetingse had established that there are two issues to be addressed; regularising those who have been in acting roles for a period of time and the process of acting for the future.
The details of time for acting has not been agreed, the unions are seeking that all those who have been acting for a two year period will be regularised but this is not agreed. The HSE are seeking confirmation that any process will be cost neutral. The Health Sector Unions referred the issue to the Labour Relations Commission and a conciliation conference was held this morning 25/05/12. The conference was facilitated by Head of Conciliation Mr Kevin Foley and Conciliation Officer, Mr Louis Mooney.
All of the issues were argued by the staff side unions and while it is likely that the HSE management team are agreeable to a process the details are not agreed. The Conciliation Officers are to prepare a discussion document now, which will be presented to the unions and management in two weeks and the proceedings were adjourned today on that basis. This document will form the basis for a resumed conciliation conference scheduled for the 13.06.12 at 4pm.
The INMO will keep you updated via the website in respect of the outcome of the next conciliation conference.
